I reserve the right to decline any commission request at my sole discretion. A reason may be provided upon request but is not required.

All commissions are digital products only. No physical goods will be shipped.

If the client wishes for the commission to remain confidential (i.e., not shown in my portfolio), an additional confidentiality fee may apply.

Deadlines must be discussed before payment. Rush orders may be declined or may incur an additional fee.

Clients must provide at least two contact methods (e.g. email, Discord, Twitter). If one fails, I will reach out via the other.

I reserve the right to refuse or cancel a commission if the client engages in inappropriate or disrespectful behavior.

Due to high demand, commissions are typically scheduled 3 to 4 months in advance.

Clients will be informed of their estimated start date before any payment is made.

Work will begin once your slot in the queue is reached.

All prices are in EUR (€).

Standard payment schedule:

- 50% upfront to reserve a slot;

- 50% before final delivery.

Clients may choose to pay 100% upfront, but the 50/50 structure is preferred.

Accepted payment methods: PayPal, Vgen, Wise, and Ko-fi.

100% refund of the amount paid is available as long as the project has not started, including during the waitlist period.

Once the work has started, a 45% refund of the total paid may be issued depending on project progress.

No refunds will be given after the project is completed and final files are delivered.

⚖️ In accordance with Article 16(m) of Directive 2011/83/EU (EU Consumer Rights Directive), the right of withdrawal does not apply to custom digital goods once production has begun, if the client was informed and consented beforehand.

By submitting the upfront payment, the client explicitly:

Consents to the creation of custom digital content;

Acknowledges that the EU right of withdrawal no longer applies after production begins;

Waives the 14-day cancellation right as allowed under Article 16(m) of EU Directive 2011/83.

Clients will receive a sketch or preview to confirm the design direction.

Progress updates are shared occasionally. Clients may request updates at any time.

Minor revisions are included. Major changes or concept overhauls may incur additional fees.

Requests for revisions after final delivery may be declined or considered a new commission.

Delivery depends on project complexity and queue status.

Most standard commissions are completed within 2-4 weeks after design begins.

Specific deadlines must be discussed and confirmed before payment.

In the case of unexpected delays, I will communicate transparently and offer alternatives or refunds as appropriate.

In case of illness, injury, personal emergencies, or other force majeure events, I reserve the right to pause or delay the project. If this occurs:

The client will be notified as soon as possible;

A revised schedule will be proposed;

If the delay is significant, a full or partial refund may be offered, depending on the project's stage.

I retain full copyright of all artwork, unless otherwise agreed in writing.

The client is granted rights only for the agreed-upon purposes (personal, promotional, or commercial use, as discussed).

Clients must provide proper credit when displaying the work publicly, using one of the following: Twitter/X: @harukoti, YouTube: @harukoti, vGen: /harukoti, Website: harukoti.com

Clients may not resell, redistribute, or modify the work without written permission.

Editable source files (.PSD, .AI, etc.) may be modified only for personal use, and may not be resold or redistributed.

The client may not use the commissioned artwork—fully or partially—for training artificial intelligence models, machine learning systems, or data mining, without explicit written consent. This includes uploading the work to any AI training datasets or databases.

I reserve the right to display finished projects in my portfolio (e.g., Twitter, Be hance, website).

If the client wishes to delay or prevent publication, this must be stated before payment. A confidentiality fee may apply.

Minor revisions are included free of charge.

Major revisions (e.g., concept changes) may result in additional charges or be declined.

Requests made long after delivery may be treated as a new project.

Ongoing support is not included unless specified in the commission agreement.

Quotes and project details are valid for 14 days from the date of proposal.

If a quote expires or the scope changes, a new quote may be issued.

Once final files are delivered, the commission is considered complete unless otherwise agreed.

By commissioning me, the client agrees:

Not to file chargebacks or disputes without contacting me first;

That chargebacks without communication constitute a breach of contract;

That I reserve the right to take legal or platform-based action in such cases.

I am not responsible for any legal, reputational, or financial consequences arising from how the client uses the final design. It is the client’s sole responsibility to ensure their use complies with copyright, trademark, advertising, or platform policies.

These Terms are governed by the laws of Portugal and relevant EU consumer and copyright laws. Any legal disputes shall be resolved in the appropriate Portuguese courts.

I reserve all the right to refuse any commission request.

After payment, the customer agrees to the Terms of Service.

If the customer wants to keep the commission confidential, additional fees will be added to the total amount.

Deadlines must be communicated and agreed upon prior to any payment. These may incur additional costs or be refused if I cannot complete the project within the timeframe requested by the client.

All projects are treated as digital goods, which means that no physical items will be shipped.

If the consumer does not respond during three contact attempts knowing that the project is on the waiting list or in the demand queue, the project is automatically canceled. There will be no refunds.

More than one contact for the consumer is obligatory. If the network have a problem with social media, I will send you a message on another platform for contact. Example: discord, twitter & e-mail.

All payments must be made in EUR (€)

Payment must be made with 50% of the amount when the commission is scheduled and 50% before the final files are delivered.

If the customer wants to keep the commission confidential, additional fees will be added to the total amount.

Only the following payment methods will be accepted: Paypal (Paypal fees are at the customer's expense), Wise, and Ko-fi.

Refund policy: 100% refund BEFORE commission starts. 45% refund AFTER commission starts. No percentage will be refunded AFTER FINALIZING the commission.

I reserve all rights to the designs made and the customer shall only use the design for the purpose for which it was designed.

Customers must credit me. You can use these networks: X (@harukoti), YouTube (@harukoti), vGen (/harukoti) or My Website (harukoti.com).

The client does not have the right to repurpose, distribute or modify any designs I have made without my permission!

If the customer purchases any editable design files (.psd, .ai, etc.), they can modify the designs themselves, but still cannot reuse or distribute them unless communicated and agreed upon prior to any payment. These extended rights may be declined or charged accordingly.

A preview or draft of the project will be provided to the client to confirm the satisfaction of the visual direction. Project updates are provided occasionally but can be requested at any time by the customer.

Minor revisions, while maintaining visual direction, are included in every project. Large or extensive revisions may incur additional fees. This is rated by me.

Any additional work outside the initial project, including edits to already completed/confirmed projects, may be declined or billed accordingly.

I reserve the right to request the removal of any commission that I believe is not in compliance with my terms and if the client does not cooperate, legal action may be taken.

All projects are sent in .PNG file unless the customer buys the editable project file (.PSD, .AI, etc).

Please, be patient. Creativity takes time and dedication. If I started your project and sent you updates or you asked me previously, just ask me for project updates every seven business days, after that time, you can ask me for updates again if I didn't send any after that period.
